A foreign suspect has been charged in the rape of a woman in Alabama over the weekend, according to reports.

The disturbing incident unfolded on Sunday in Opelika, a city in Lee County.

The Opelika Police Department launched an investigation into the alleged attack and arrested 24-year-old Erin Roelmer Ramos-Perez.

Ramos-Perez is accused of engaging in “sexual intercourse with a woman who was incapable of consent due to being physically helpless or mentally incapacitated — specifically, while she was asleep,” according to court records reviewed by WRBL.

Ramos-Perez has been charged with first-degree rape.

Additionally, Immigration and Customs Enforcement has lodged a detainer against Ramos-Perez, indicating he may in the U.S. illegally.

The suspect is being held without bond pending a hearing under Aniah’s Law, which affords judges the ability to deny bail to suspects facing serious charges such as murder, rape, and kidnapping.

Earlier this month, an illegal alien with an outstanding warrant for first-degree rape in Opelika was arrested at Atlanta Hartsfield-Jackson Airport as he attempted to flee to his home country of Guatemala.

Artemio Garcia Perez, 20, was taken into custody, along with his brother, Jose Luis Maldonado Perez, who was charged with first-degree hindering prosecution.
